Legal terms relating to the purchase
GAMMA EXPORT S.R.L with VAT NUMB IT03786160154 sells and distributes products offered in this service.
The purchasing system depends on the legislation in force in Italy. Therefore, the sales operations are managed by Gamma Export, Via Giacomo Watt 37, 20143, Milan.
The purchase of certain types of items is subject to certain special conditions (restrictions on the supply of alcoholic beverages, prevention…). Drinking alcoholic beverages is not permitted under the age of 18.
We offer a wide selection of products/goods that can be picked up in our national or international logistic centers by collaborators of our customers.
The products offered in this service are directed mainly to businesses.
Information on data protection
Gamma Export is fully compliant to European GDPR.
Industrial and intellectual property rights
The contents as well as the images connected to Gamma Export service include details, logos, brands and icons protected in accordance with the different national and international legislations regarding Industrial and Intellectual Property Rights.
The reproduction, transformation, public communication and/or use, whether total or partial, of services of Gamma Export is not authorised, unless indicated with the prior written consent of Gamma Export. Likewise, the use of hardware or technology that would permit it, is not permitted.
The unauthorized use of the content, brands, logos, data or information related to the service of Gamma Export, and which entails infringement of our rights of Industrial Property, Intellectual Property, Industrial Secrets, etc., will be prosecuted before the competent Courts.
Use and access to the service
The user always follows these Terms and Conditions to grant a non-exclusive, non-transferable, limited license to technical tools needed to buy goods from Gamma export. The User License does not include the right to manipulate technical tools provided by Gamma Export integrated to the payment journey, for the benefit of another company or an entity different from Gamma Export.
Any infringement of these Conditions of Use will require the cancellation of the user license granted by Gamma Export, as well as the possible initiation of actions in defense of our rights.
Opinions, comments, communications and other contents
Users will be able to communicate opinions and comments that they consider appropriate regarding the purchased products, as well as send suggestions, queries or other information, which they consider related to the purchased product, as long as the content of the same is legal, does not go against good customs, do not suppose harm or defamation against third parties, invade the privacy of third parties, or suppose an infringement of the rights of intellectual property. These communications shall be sent writing an email to
Info@gammaexport.it and must not contain computer viruses, consist of political propaganda or advertising content, periodic mailings, mass mailings or constitute any other type of “spam”. The use of incorrect email addresses, or acts that could impersonate other people, are also not permitted. Gamma Export will carry out the necessary controls to prevent any of the acts established in the previous paragraph from being committed, reserving the right to deny the service.
By communicating to Gamma Export any comment, content or presentation, the user grants and assigns to Gamma Export:
(a) the non-exclusive, free right, for the maximum time allowed by Law, worldwide and subject to full transfer and transmission in favour of a third party, for the reproduction, alteration, public communication of any text, image or drawing, through any means and by any advertising medium;
(b) the right to use the name provided to us in connection with such content.
By providing the content and/or comment, the client guarantees that he is the owner of the intellectual property rights over them, and that he does not violate the industrial or intellectual property rights of any third party, leaving Gamma Export completely harmless from any type of claim that he/she may receive, as a consequence of the reproduction and/or public communication of said content.
Responsibility for the use of the payment tools
Gamma Export makes and will make its best efforts to ensure that the temporary use of the payment tools is possible, as well as the absence of errors in any transmission of information that may take place, but since said service depends on other third parties, such as telephone companies, Internet servers, etc., or the need to carry out repair or maintenance work, which will be carried out in the shortest possible time, uninterrupted use of the service cannot be guaranteed.
Gamma Export will not be responsible for:
(i) any losses that were not attributable to any breach on your part;
(ii) business losses (including lost profits, revenue, contracts, anticipated savings, data, loss of goodwill or unnecessary expenses incurred);
(iii) any indirect or consequential losses that were not reasonably foreseeable by both parties at the time the user began using Gamma Export service.
Gamma Export will not be responsible for delays or failure to fulfill its obligations under these conditions, if such delay or failure was due to causes of force majeure or attributable to circumstances beyond Gamma Export, without prejudice to the user’s right to receive the product or the provision of the service within a reasonable time, or to receive a refund of the purchase in the event that it couldn’t deliver the requested products or services within a reasonable time.
The payment methods foreseen are:
- a link on an email sent to the customer, who will press it to pay via Mobysign app (see https://mobysign.com/terms-and-conditions/?lang=en for their Terms and Conditions) or by typing credit/debit card details eventually registered on Mobysign safe servers PCI certified by Mobysign
- a confirmation via push notification on the popup appearing on Mobysign app on the smartphone of the payer, after that the operator of Gamma Export sent to him/her a payment request via the Internet using his/her Mobysign nickname or phone number as a user identifier.
Modification of the service or variation of the conditions
Gamma Export reserves the right, at any time, to make changes to its service, as well as to the terms of these General Conditions of Use.
The User will be considered to accept said modifications if they use said service after said modifications. If any of these Conditions of Use are declared null or ineffective, said condition will be understood to be excluded without said declaration affecting the validity or enforceability of the rest of the conditions.
Resignation
The fact that Gamma Export does not exercise its rights at a specific time, in the event of non-compliance with these conditions or infringement of its rights by the users of its services, does not mean that it renounces them, being able to exercise them at the time Gamma Export considers appropriate.
Minors
Only those of legal age can be Users of the service. Products or services that are aimed at minors can only be purchased by their parents or guardians.
The sale of alcoholic beverages to minors under 18 years of age is not permitted.
Return policy
Gamma Export as well as third parties that sell through Gamma Export, offer the return of most products within a period of 30 days from receipt of the same by the consumer. Most of the products sold by Gamma Export are subject to the general returns policy, however some of them have certain peculiarities when returning them.
Withdrawal rights
You are guaranteed by law the right to withdraw from the purchase contract, without indicating the reason, for most products during 14 calendar days from the day you received the product. To cancel a purchase during the 14-day cooling-off period, drop an email to clients.compra@gammaexportinbond.com. This withdrawal option does not apply to perishable products.
Gamma Export Return Policies
Regardless of the right of withdrawal described above, Gamma Export’s return policy allows you to return the products in case you are not satisfied with your purchase up to 30 days from the date of receipt of the product.
The products must be returned in the same condition as you received them. Therefore, new products must be returned new, unused and complete. Second-hand products must not show additional damage or signs of use.
The same exceptions to the right of withdrawal apply to our returns policy. The following products cannot be returned except in the case of defective products:
• Products that do not allow their return due to hygienic or health protection reasons if they have been unsealed by you after delivery (for example cosmetic products), or that were, after delivery, inseparably mixed with other products;
• Products that may deteriorate or expire quickly (for example food or perishable products or products subject to an expiration date);
• Sealed sound or video recordings or sealed software if they are unsealed by you after delivery;
•Goods made to your specifications or clearly personalized, specifically including Gamma Export handmade products;
•A Gamma Export service if it had been provided and you had accepted its provision when you requested the service
•Digital content (including apps, digital software e-books, MP3, etc.) that would not have been delivered on a physical medium (i.e., not contained on media such as CD or DVD) if you had consented to the execution at the time of delivery and without it being possible to withdraw from that moment. If an eBook has been read partially or in cases of abuse, refunds may be denied.
•Daily press, periodicals or magazines with the exception of subscription contracts; and;
•Alcoholic beverages whose price has been agreed upon at the time you placed the order and which cannot be delivered within 30 days, and whose real value depends on fluctuations in the market that we cannot control.
•Gamma Export Gift Vouchers cannot be returned. However, unused Gamma Export Gift Vouchers may be eligible for a refund. For more information, contact our Customer Service.
Note: if you return an item sold or sent by Gamma Export, we will refund the amount of the product as well as the return costs. If the item you purchased was not eligible for a free return and you use a prepaid return label, we will deduct the shipping costs from the total refund amount.
This returns policy does not affect your legal rights as a customer.
Erroneous returns
Please be sure to include the correct and complete product when making a return. To receive a refund, the correct product must be returned.
If you have mistakenly sent the wrong product to Gamma Export, please contact Customer Service as soon as possible, as Gamma Export has no obligation to custody or store incorrect or erroneous returns. Gamma Export cannot guarantee that your product will be found and returned, and no compensation is given for incorrect products sent to Gamma Export.
Defective product
You can claim that a product is defective for two years from the date you received the product.
Note: If your product is defective, please first consult the product documentation, such as the user guide for troubleshooting suggestions, or contact the manufacturer. Under the manufacturer’s warranty, the manufacturer normally has the option of repairing the product or replacing individual parts of the product. Gamma Export will not carry out the replacement of any part of the product that is missing or defective nor will it offer technical assistance for it if it is not the manufacturer.
If you cannot resolve the problem with the help of the product documentation, you can file a claim with Gamma Export within a period of three years from the date of receipt of the product.
For products not suitable for repair, our Returns Support Center can only be used on a limited basis for complaints made after 30 days from the date of receipt. Please contact our Customer Service so we can help you exercise your warranty right.
Defective product: 3 years from the date of receipt
The legal warranty lasts three years from the date of receipt of the product. Therefore, we do not accept returns of products once this period of time has passed. Contact the manufacturer to try to solve the problem.
Note: when Gamma Export sends you a replacement for a damaged or defective product, you must return the original product within 30 days from the date on which we confirm the replacement order. If you do not return the original product to us within this 30-day period, Gamma Export reserves the right to charge the price of the replacement product to the same payment method that you used to confirm the order.
Product damaged during shipping
If you receive a product that was damaged during shipping, please refer to our Returns Center (clients.compra@gammaexportinbond.com) to return it within 30 days from the date you received your order or contact our Customer Service.
Note: For defective or damaged products purchased from third-party sellers that have been shipped by the seller, please contact the seller. Do not return such products directly to Gamma Export.
Gamma Export Products Own Store
Most Gamma Export Global Store products can be returned within 30 days from the date of receipt. Refer to Returns Center (clients.compra@gammaexportinbond.com). We will issue a refund within 14 days and confirm it with an email. You will be able to see it on your bank statement within a maximum period of 7 days from the issuance of the refund. In certain circumstances, the refund issuance period may be longer. If the products are incorrect, faulty or damaged, you will be refunded the original shipping costs as well as the import duty deposit on the returned products once the return has been processed.
For some of the Gamma Export Own Store products, you will be offered the same return methods as a standard Gamma Export return. For others, you will be provided with a prepaid return label.
How do we calculate return shipping costs?
If you want to return a product that is not eligible for free return and you use a postage-paid return label, we will deduct the return costs from the total refund amount.
Products exempt from return costs
Products sold or shipped by Gamma Export are exempt from return costs regardless of the reason for the return, as long as it is made within 30 days from the date of receipt of the product. Free returns are not available for heavy and bulky items.
Deletion of personal data
When returning a product, regardless of the reason, you must do so in the same condition in which you received it from Gamma Export. In this sense, you must delete all personal data about you and/or a third party that may be present in said article, and you must modify the account settings so that it can no longer remember them. You will be fully responsible for any data breach that may occur if you do not proceed as we indicate. From the returned product and the box containing it, you must remove any element that is not related to said returned product, as it was initially received from Gamma Export. Gamma Export will not be responsible for any items left by mistake in the returned product or in the box containing it. You agree and accept that the returned product will become the property of Gamma Export and that, therefore, Gamma Export has the right to sell it to third parties at its discretion.
